Terms of Service

These Terms of Service (“Terms”) govern your use of the FitBear website and mobile application (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be able to form a binding contract in your jurisdiction to use the Services. The Services are not intended for children.

2. Your account

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for activity that occurs under your account.
• You must provide accurate information and keep it up to date.

3. Health and safety disclaimer

• The Services do not provide medical advice, diagnosis, or treatment.
• Always use good judgment and stop if you experience pain, dizziness, or discomfort.
• Consult a healthcare professional before starting a new exercise or nutrition program, especially if you have a medical condition or injury.

4. User content

You may provide content such as messages, profile data, and optional photos (“User Content”). You grant FitBear a non-exclusive, worldwide, royalty-free license to use User Content solely to operate, maintain, and improve the Services (including generating coaching responses and analyzing images when you choose to use those features).

If you connect Apple Health or another supported health source, imported daily summaries are also treated as User Content for service operation under these Terms, subject to your privacy and consent settings.

You represent that you have the right to provide User Content and that it does not violate law or infringe third-party rights.

5. Prohibited conduct

• Use the Services for unlawful, harmful, or abusive purposes.
• Attempt to probe, scan, or test the vulnerability of any system or network.
• Reverse engineer, decompile, or attempt to extract source code except where permitted by law.
• Interfere with or disrupt the Services, including by introducing malware.

6. Subscriptions and payments (if offered)

If the Services offer paid features, pricing and billing terms will be presented to you at the time of purchase. Subscriptions may be processed through Apple App Store or Google Play (as applicable). You can manage or cancel subscriptions through your store account settings. Deleting your FitBear account does not automatically cancel a store-managed subscription.

7. Intellectual property

The Services, including text, graphics, logos, and software, are owned by FitBear or its licensors and are protected by intellectual property laws. You may not use FitBear branding without permission.

8. Third-party services

The Services may rely on or integrate with third-party services (for example, hosting, analytics, payment processors, and AI providers). Your use of those third-party services may be subject to their terms and policies.

9. Termination

We may suspend or terminate your access to the Services if you violate these Terms or if we reasonably believe your use creates risk or legal exposure. You may stop using the Services at any time, and you can delete your account in-app from Profile → Privacy & data → Delete account.

10. Disclaimers

To the maximum extent permitted by applicable law, the Services are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the maximum extent permitted by applicable law, FitBear and its affiliates, officers, employees, and suppliers will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Services.

Some jurisdictions (including some Canadian provinces) may not allow certain limitations. In such cases, these limitations apply to the fullest extent permitted by law.

12. Governing law

These Terms are governed by the laws of Canada and the laws of the province or territory in which FitBear is based, without regard to conflict of law principles.

13. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will update the “Last updated” date and may provide additional notice.
